Welcome to Bana Bilaka. These Terms of Service (“Terms”) govern your use of our website banabilaka.com and your purchase of our products. By placing an order or using our site, you agree to these Terms. Please read them carefully.

2. Eligibility

To place an order, you must be at least 18 years old (or have parental consent) and capable of entering into a legally binding contract under the laws of England & Wales.

3. Products

Bana Bilaka sells print-on-demand apparel (t-shirts, sweatshirts) and posters celebrating African greatness and pan-African pride. All products are made to order — we hold no physical stock. Each item is produced by our trusted fulfilment partners (Gelato in the UK/EU, Printify in the US) after you place your order.

Product images, colours, and descriptions are provided in good faith. Slight variations in colour, fit, or print placement may occur due to the nature of print-on-demand production. These variations are not defects.

4. Pricing & Currency

All prices are listed in British Pounds Sterling (GBP) and include VAT where applicable.
Shipping costs are calculated at checkout and shown before you confirm your order.
We reserve the right to change prices at any time. Changes will not affect orders already placed.
In the event of an obvious pricing error, we reserve the right to cancel the order and refund you in full.

5. Payment

Payments are processed securely via Stripe. We accept major credit and debit cards (Visa, Mastercard, American Express) and other methods displayed at checkout.
Your card is charged at the time of order.
We do not store full card details. All payment data is handled by Stripe under PCI-DSS standards.

6. Order Acceptance

When you place an order, you receive an order confirmation email. This is not acceptance of your order — it is acknowledgement that we received it. A binding contract is formed only when we send you the shipping confirmation email.

We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) cases of:

Suspected fraud
Pricing errors
Stock or production issues
Inability to deliver to your address

If we cancel your order, we will refund you in full.

7. Shipping & Delivery

Please refer to our Shipping Policy for full details on delivery times, costs, and regions served. In summary:

UK: 5–10 business days (fulfilled by Gelato)
EU: 5–10 business days (fulfilled by Gelato)
US: 7–12 business days (fulfilled by Printify)

Risk of loss passes to you upon delivery.

8. Returns & Refunds

Because our products are made to order, we do not accept returns for change of mind or wrong size selection. We do accept refunds or reprints for defective items, misprints, or errors on our part. Please refer to our Refund Policy for the full process.

Nothing in these Terms affects your statutory rights under the UK Consumer Rights Act 2015 or applicable EU consumer law.

9. Intellectual Property

All designs, illustrations, artwork, logos, text, photographs, and graphics on banabilaka.com are the exclusive property of Bana Bilaka and are protected by UK and international copyright, trademark, and intellectual property laws.

You may not:

Copy, reproduce, redistribute, or resell our designs in any form
Use our artwork on other products or platforms
Remove any copyright or trademark notices from our products
Use our brand name or logo without our prior written consent

Purchasing a product gives you ownership of that physical item only — it does not grant any rights to the design itself.

10. User Conduct

When using our site, you agree not to:

Engage in fraudulent or unlawful activity
Attempt to gain unauthorised access to our systems
Use our site to send spam or harmful content
Infringe the rights of others

We reserve the right to suspend or terminate access to our site for breach of these Terms.

11. Limitation of Liability

To the maximum extent permitted by law:

Our total liability to you for any claim arising from these Terms or your purchase is limited to the amount you paid for the relevant product.
We are not liable for indirect, consequential, or incidental losses (including loss of profit, data, or goodwill).
Nothing in these Terms limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, supply chain disruptions, or actions of third-party carriers and fulfilment partners.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales, except where mandatory EU consumer protection law gives EU residents the right to bring proceedings in their country of residence.

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. Continued use of our site after changes constitutes acceptance of the new Terms.
